As per Law Only 2 Member Sayed Wasif Islam & Khan Shahabuddin Nasim is the current authority of Kakrail Markaz.

Bangladesh Tabligh Markaz Trust was formed and registered on 7.03.2013 mainly to build a Kakrail Markaz Complex.

Below the details:

There’s a legal action to take measures to dissolve the Bangladesh Tabligh Markaz Trust, which is currently inoperative, dis-functional and dead.

On behalf of Liaquat Ali Siddiqui this legal notice has instructed:

(1) That Bangladesh Tabligh Markaz Trust was formed and registered on 7.03.2013 mainly to build a Kakrail Markaz Complex, with an initial capital of BDT 5 (Five) lakhs.

Below mentioned 1-6 individuals are the Trustees of Bangladesh Tabligh Markaz Trust, appointed by the Shura of Tabligh Jamat, Bangladesh, to run the Trust and to remain accountable to the Shura, Bangladesh as of 7.03.2013. All 6 members were appointed by the World Markaz Nizamuddin:

Muhammad Jubair, S/O Late Haji Shamsul Haq, 540/C Khilgao, Dhaka.

Khan Shahabuddin Nasim, S/O Late Abdul Majid Khan, House No. 23, Road, 7/A, Sector 10, Uttara, Dhaka.

Md. Rabiul Haq, S/O Late Haji Balu Mia Shawdagor, House No. 31/1 Tupkhana Road, GPO. 1000, Dhaka.

Md. Farooq, S/O Maw Md. Abdullah, Village. Piarpur, Lakshmipur.

Syed Wasif Islam, S/O Late Syed Farukul Islam, 25 Dhanmondi, Road no. 4, Dhaka.

Muhammad Hussen, S/O Late Munshi Abdus Salam, P/S Komolnogor, Lakshmipur….(now, dead).

(2) That the above named 1-6 individuals are the Trustees of Bangladesh Tabligh Markaz Trust, appointed by the Shura of Tabligh Jamat, Bangladesh, to run the Trust and to remain accountable to the Shura, Bangladesh.

(3) The 10 members of the Shura of Tabligh Jamat, Bangladesh were previously appointed by the World Tabligh Markaz, known as, Nizamuddin Markaz, Delhi, India being the highest authority of the historic Tabligh movement across the world, of which Bangladesh Tabligh Jamat is a chapter only. You 1-6 individuals were also included among the 10 members Shura of Tabligh Jamat, Bangladesh and also appointed by the above mentioned same authority.

(4) That the no. 6 Shura Muhammad Hussen died few years before.

(5) That in 2018 above mentioned 1, 3 and 4 numbers of the Board of Trustees, left the Tabligh Jamat (mainstream) led by Nizamuddin Markaz, Delhi, India under the leadership of (Amir) Hazrat Mawlana Sa’ad Sab (d.b.), great grandson of Hazrat Mawlana Ilias (R.A.), original founder of the World Tabligh Jamat.

(6) That since then above mentioned 1, 3 and 4 members of the Board of Trustees have formed a separate movement called “Shurai Nizam” by disobeying the decision of World Tablig Markaz.

(7) That the above mentioned three Shura were subsequently removed by the Nizamuddin Markaz from the list of the Shura authorised by the Nizamuddin Markaz to run the Tabligh and Dawah activities in Bangladesh. As a result, they have lost the moral and ethical grounds to remain any more as the members of the Board of Trustees. Under Articles 3 and 4, of the Trust Deed, no. IV-13 dated 07. 03.13, they have become legally unfit to hold the post of members of the Board of Trustees any more.

(8) That due to the division, separation, and disagreements, the Trust has been rendered a dis-functional, inoperative and dead organization over the last 7 years. Not a single meeting of the Trustee Board took place during this period. There is no hope that the Trust will become operative in near future.

(9) That under Article 10 of the Trust Deed, this Trust is non-voidable. However, in case of failure, through mutual agreement of all the parties, the money deposited in the Bank could be used for the construction of the Complex.

Therefore there was a legal notice already served:

(10) That under the above mentioned circumstances, our client solicit from the above mentioned 1 to 5 numbers of members of the Board of Trustees, their individual opinion in writing regarding the conclusion or the termination of the Trust within 30 days of the receipt of this legal notice.

(11) That meanwhile number 1 member Muhammad Jubair should restrain from claiming himself to be the Chairman of the Trust, as he was, under a mutual agreement of the members of the Trustee Board, appointed as the Chairman for the two year period only, which was over long time before. Claiming Chairman of the Trust by him (Muhammad Jubair) seems bo be an illegal act under the existing laws of Bangladesh.
